1. Acceptance of terms
By accessing or using Art Index Africa (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.
We may update these terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised terms.
2. Use of the Platform
Art Index Africa is a discovery and inquiry platform for African and Black art across the continent and the global diaspora. Verified organisations — galleries, dealers, advisors, institutions and estates — publish records; collectors and other users may browse, save, follow and submit inquiries.
The Platform is not an open marketplace. We do not process payments or facilitate transactions directly. Any sale, purchase or exchange arising from an inquiry made through the Platform is a matter between the collector and the relevant organisation, whether concluded on or off the Platform.
3. User content
You may submit content to the Platform, including profile information, inquiries, saved lists and other materials ("User Content"). You retain ownership of your User Content, but grant Art Index Africa a non-exclusive, worldwide licence to host, display and process it as necessary to operate the Platform.
You are responsible for ensuring that any User Content you submit is accurate and does not infringe the intellectual property, privacy or other rights of any third party.
4. Communications and newsletters
When you create an account, you're automatically subscribed to platform communications from Art Index Africa — new works, editorial features, fair previews and market notes. You can decline this at sign-up, or unsubscribe at any time afterward.
You can manage or stop these communications at any time from your account settings, or by using the unsubscribe link included in any email we send you.
We use a third-party email delivery provider to send these communications on our behalf. They only process the information needed to deliver your messages and are not permitted to use it for any other purpose.
5. Prohibited activities
You agree not to: misrepresent your identity or affiliation with any organisation; submit false, misleading or fraudulent provenance, ownership or verification information; attempt to circumvent our trust and verification processes; scrape, harvest or bulk-collect data from the Platform without authorisation; interfere with the security, integrity or normal operation of the Platform; or use the Platform for any unlawful purpose.
6. Limitation of liability
Art Index Africa verifies organisation identity, provenance documentation and reproduction rights to the standards described in our Trust Policy, but does not guarantee the accuracy, completeness or authenticity of any listing, and is not a party to any transaction between a collector and an organisation.
To the fullest extent permitted by law, Art Index Africa disclaims liability for any loss or damage arising from your use of the Platform or reliance on information published on it, including losses arising from transactions conducted off-platform.
7. Governing law
These Terms are governed by the laws of the jurisdiction in which Art Index Africa is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform is subject to the exclusive jurisdiction of the courts of that jurisdiction, except where local consumer-protection law provides otherwise.
